Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Femmé waitlist, website, and platform ("Services"), operated by Femmé ("we", "us", or "our"). By signing up for the waitlist or otherwise using our Services, you agree to be bound by these Terms. Please read them carefully.

Eligibility and Age Requirement

You must be at least 18 years of age to access or use Femmé. By using the platform, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use or access this platform under any circumstances.

To use Femmé, you must also:

Be able to enter into a legally binding agreement in your jurisdiction.
Not be prohibited from receiving services under applicable laws.
Comply with all applicable local, state, national, and international laws and regulations.

All accounts are subject to identity verification. Providing false information during verification — including misrepresenting your age — is grounds for immediate, permanent removal from the platform and may be reported to relevant authorities.

Waitlist

By joining the Femmé waitlist, you provide your email address and optional feedback. We will use this to communicate updates about the product. You can unsubscribe at any time using the link in any email we send. Joining the waitlist does not guarantee access to the platform or any particular feature.

User conduct

You agree not to:

Impersonate any person or misrepresent your identity or affiliation.
Harass, threaten, or demean other users in any form.
Share, redistribute, or reproduce content from the platform outside of it without explicit permission from the creator.
Attempt to circumvent identity verification or any security measure.
Use automated tools to scrape, crawl, or extract data from the platform.
Upload content that violates applicable laws, including laws relating to child safety.

Violation of these rules may result in immediate account termination with no right of appeal. For violations involving safety or illegal content, we may be required to report to relevant authorities.

Content

Creators retain full ownership of the content they upload. By posting to Femmé, you grant us a limited, non-exclusive licence to store, display, and distribute your content to your subscribers through the platform.

You are solely responsible for ensuring your content complies with applicable laws and does not infringe third-party rights. We reserve the right to remove content that violates these Terms or our content policies without notice.

Adult Content Policy

Femmé permits adult content, including sexually explicit material, only under the following conditions:

All persons depicted in adult content must be verified to be at least 18 years of age at the time of content creation.
Creators who upload adult content are solely responsible for maintaining the age verification records required under 18 U.S.C. § 2257 and all applicable regulations.
All adult content must be clearly designated as subscriber-only. It may not be publicly accessible or visible to non-subscribers.
Creators must obtain express, documented consent from all persons depicted in adult content before uploading.

Prohibited Content

The following content is strictly prohibited and will result in immediate account termination and reporting to law enforcement:

Any content depicting, suggesting, or involving individuals under the age of 18 in a sexual or explicit context.
Non-consensual content of any kind, including content recorded or distributed without the consent of those depicted.
Content that depicts, promotes, or glorifies violence, rape, or sexual coercion.
Bestiality or content involving animals in a sexual context.
Content that violates any applicable local, national, or international law.
Content involving real persons whose identity is used without their explicit consent.
Deepfakes or AI-generated content depicting real, identifiable individuals in sexual situations without their consent.

We actively monitor for violations and cooperate fully with law enforcement investigations related to any of the above.

Record-Keeping — 18 U.S.C. § 2257

Femmé complies with 18 U.S.C. § 2257 and 28 C.F.R. Part 75. Creators who upload sexually explicit content are responsible for maintaining records verifying that all depicted individuals were at least 18 years of age at the time of production. Upon request, creators must provide such records to Femmé or to any duly authorized inspection agency. Femmé's full 2257 Compliance Statement is available at femmé.com/2257.

DMCA — Copyright Policy

Femmé respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on our platform infringes your copyright, please submit a notice to our designated DMCA agent. Details and the full process are available at femmé.com/dmca.

Repeat infringers will have their accounts terminated in accordance with our repeat infringer policy.

Payments and Revenue

Payments on Femmé are processed by CCBill, our authorised payment processor. By using payment features, you agree to CCBill's terms of service and privacy policy, which will be presented at checkout. Femmé retains a 10% platform fee on creator earnings where applicable.

Payouts are subject to applicable tax withholding and identity verification requirements.

Your transaction descriptor on card statements will reference Femmé and/or our CCBill descriptor details shown at checkout.

Refund and Cancellation Policy

Subscriptions: Subscribers may cancel their subscription at any time in account settings or by contacting support. Cancellations take effect at the end of the current billing period; no partial refunds are issued for unused time within a billing period.

Refunds: Refunds are issued at our discretion in cases of documented technical failure preventing access to purchased content. Refund requests must be submitted within 7 days of the charge to billing@femme.com with your account email and a description of the issue.

Tips and pay-per-view: All tip and pay-per-view transactions are final and non-refundable unless a technical error prevented delivery of the purchased content.

Chargebacks: If you initiate a chargeback without first contacting us, we reserve the right to suspend or terminate your account. We respond to all chargeback disputes promptly with complete transaction records.

Customer support: Billing support is available at billing@femme.com. We target first response within 24 hours on business days.

Disclaimers

The Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, accuracy of content posted by users, or suitability for any particular purpose. We are not liable for content posted by users of the platform.

Limitation of liability

To the maximum extent permitted by law, Femmé and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to lost revenue, lost data, or loss of goodwill. Our total liability for any claim is limited to the greater of the amounts you paid us in the 12 months preceding the claim or $100.

Termination

We may suspend or terminate your access to the Services at any time, for any reason, with or without notice. You may stop using the Services at any time. On termination, provisions that by their nature should survive (including content ownership, payment obligations, and limitation of liability) will continue to apply.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware.

Changes to these Terms

We may revise these Terms as the platform develops. If we make material changes, we will notify waitlist members by email at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
